Legal Steps to Take During a Hit and Run Accident

A hit-and-run accident can be a traumatizing experience. They are a common occurrence on the roadways of Alberta, so it’s best to be prepared in the event it happens to you. Knowing what steps you should take when you are involved in one can help ensure you are able to recover as best you can. 


Here are the steps you should take if you are involved in a hit-and-run accident: 


Step 1: Stay on the Scene

Whether or not you’re at fault for the accident, leaving the scene of an accident is illegal. Remain there until the authorities get there. Drivers may often leave the scene simply due to shock and panic, or fear of consequences. Leaving the scene can leave you open to significant personal and financial consequences, however. 


Step 2: Check for Injuries

If you are injured, make sure you get medical attention as soon as you can. You may be entitled to injury benefits


Step 3: Contact the Police

If you have sustained injuries or the damages are greater than $5000, you are legally required to call the police and report the accident. 


Step 4: Collect Contact Information from Witnesses and Record Their Statements

If there are any witnesses, make sure you get their contact information. Witnesses will be important for insurance claims, especially if you are filing for personal injury benefits.


Step 5: Write Down Details of the Accident

Human memory can be flawed, so make sure you record all the details of the accident while they are fresh in your mind. Take high-quality photos of any vehicles involved (if they are still around), record the weather conditions, and write down the events that led to the collision, and any other details that may be relevant. 


Step 6: Contact the Tow Truck if Necessary

If your car has been damaged beyond driveability, you’ll need to contact a towing service to take it to a repair shop. If you drive a vehicle that’s been compromised, you may be putting yourself and other passengers at further risk.


Step 7: Visit the Police Station

If the damages are under $5000, you will not get an accident police report.  If your damages are above $5000, You will need to complete an accident report at the police station. Make sure you stick to the police instructions while you are completing your report. 


Step 8: Call Your Insurance Company

Once you’ve finished the accident report, you should call your insurance company right away. They will be able to help you with the claims process to get your vehicle repaired and set up your treatments if you have been injured.
