What is a CAP Claim?

In 2004, the Alberta Government put a limit, or cap, on the amount of compensation an individual can receive from a minor soft tissue injury suffered in a motor vehicle accident.

In 2020, the Alberta Treasury Board and Finance raised the cap amount to $5,296.

How Is a CAP Claim Determined?

To be considered a CAP Claim, the injuries suffered must be soft tissue injuries. This is defined as damage to the tissue, ligaments, muscles, and tendons of the body that do not cause long-term issues affecting the ability to work or live normally.

Whether an injury is considered “minor” or “capped” depends on the specific situation. It is determined by medical records and the nature and duration of treatment received.

What Injuries Are Not Covered By a CAP Claim?

Injuries outside of a minor soft tissue injury are not covered, and include:

  • Broken bones
  • Spinal cord or brain injuries
  • TMJ
  • Chronic pain
  • Fibromyalgia
  • Mental, emotional, or psychological trauma

Please note that in some cases, TMJ and mental, emotional, or psychological trauma can be considered a CAP claim if these injuries heal within a certain time frame. Please discuss these injuries in more detail with our lawyers during your free consultation.
